1. Introduction and Definitions
1.1 These Terms and Conditions (“Terms”) govern the relationship between Scaleford Education Ltd (incorporated in England & Wales, “we”, “us”, “our”) and the student (“Student”) and/or their parent/guardian (“Parent”) accessing our website (scaleford.com) and educational services (“Services”).
1.2 By purchasing a course, enrolling, or accessing the Services, you agree to be bound by these Terms, the Privacy Policy, and the Refund & Cancellation Policy.
2. Eligibility and Admissions
2.1 Minors and Parental Consent: If the Student is under 18 years of age, a Parent or Guardian must complete the registration and accept these Terms on the Student’s behalf. The Parent guarantees they have the legal authority to bind the Student to these Terms.
2.2 Prerequisites: Students are responsible for ensuring they meet the academic prerequisites for specific curricula (IB, CAIE, CBSE, AP, etc.) as listed in the course description prior to enrollment.
3. Payment, Fees, and Subscription
3.1 Fees and Payment: All course fees are listed on the Scaleford website and are due in advance of the module start date. Payment processing is handled securely by third-party payment processors (e.g., Stripe, PayPal), and you agree to their respective terms of service when making a purchase.
3.2 Course Structure and Non-Transferability: Courses are purchased on a per-module basis (typically 6-week modules). Once purchased, modules and associated access are non-transferable between students.
3.3 Price Changes: We reserve the right to change course fees at any time. Such changes will not affect the price of any modules already purchased and paid for.
3.4 Refund and Cancellation Policy: All cancellations, refunds, and withdrawal requests are governed by our separate Refund & Cancellation Policy, available at Refund & Cancellation Policy. By agreeing to these Terms, you acknowledge and agree to be bound by the terms of the Refund & Cancellation Policy.
4. Services Provided and Accessibility
4.1 Service Description: We provide live online tuition, 6-week modular courses, and inquiry-based learning materials aligned with Global Curricula (IB, CAIE, CBSE, AP, etc.) via qualified expert instructors.
4.2 Delivery Platforms: Sessions are delivered via Google Meet and managed through Google Classroom and our Learning Management System (LMS). Access to these platforms is included in the course fee.
4.3 Accessibility: We are committed to inclusive learning. If the Student has Special Educational Needs (SEN) or requires reasonable adjustments, please inform us at care@scaleford.com prior to the course start so we can discuss potential accommodations.
5. Code of Conduct & Acceptable Use
5.1 Behavior and Non-Discrimination: We enforce a zero-tolerance policy towards bullying, harassment, or discrimination based on race, religion, disability, or gender. Breaches of this policy will result in immediate suspension from the Services without refund.
5.2 Online Etiquette: Students must engage respectfully, use appropriate language, and adhere to a professional dress code during video calls. Keeping cameras on is expected unless agreed otherwise with the instructor.
5.3 Technology and Security: You agree not to distribute viruses, misuse the LMS, or attempt to record, transcribe, or share live sessions or course materials without explicit written permission from Scaleford Education Ltd.
6. Intellectual Property (IP)
6.1 Ownership: All course materials, videos, PDFs, masterclasses, and pre-recorded content provided by Scaleford Education are our exclusive Intellectual Property and are protected by copyright.
6.2 License: You are granted a limited, non-exclusive, non-transferable license to use these materials strictly for the Student’s personal, educational study only. Sharing, reproducing, reselling, or uploading materials to third-party sites is strictly prohibited and constitutes a breach of these Terms.
7. Media & Marketing Consent
7.1 Academic Use: By enrolling, you grant us permission to use anonymized data regarding academic achievements and progress for internal development, quality assurance, and statistical marketing purposes.
7.2 Visuals and Recording: We may record sessions for safeguarding, quality assurance, and instructor training. If we wish to use the Student’s image, voice, or testimonials for external marketing or promotional materials, we will seek separate, specific written consent (Opt-in) from the Parent/Guardian.
8. Liability & Disclaimers
8.1 Educational Content “As-Is”: Our courses are educational aids provided “as-is.” We do not guarantee specific outcomes, exam results (e.g., specific grades in NEET, JEE, IB Diplomas), or success in any academic field.
8.2 Limitation of Liability: We are not liable for technical failures on your end (e.g., internet connection, hardware malfunctions) that prevent the Student from accessing the Services. Our total liability to you for any claim arising out of these Terms is limited to the fees paid by you for the specific module giving rise to the claim.
9. Governing Law
9.1 These Terms, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales.
9.2 The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms.
